1. Acceptance of Terms
By accessing or using Pollburst ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including visitors, free users, and paid subscribers.
2. Description of Service
Pollburst is an online polling and survey platform that allows users to create, share, and analyze polls and surveys. The Service is provided "as is" and may be updated, modified, or discontinued at any time with or without notice.
3. User Accounts
To use certain features of the Service, you must create an account using Google OAuth or email magic link. You are responsible for maintaining the security of your account and for all activities that occur under your account. You agree to notify us immediately at nevacfrazier03@gmail.com if you suspect any unauthorized use of your account.
You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement.
4. Acceptable Use
You agree not to use the Service to:
- Create or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Collect sensitive personal information from respondents without proper disclosure
- Spam or send unsolicited communications
- Attempt to gain unauthorized access to the Service or its systems
- Violate any applicable local, national, or international law or regulation
- Impersonate any person or entity
We reserve the right to suspend or terminate accounts that violate these guidelines without notice.
5. Plans and Payments
Pollburst offers a free plan and paid Pro plan. Free plan users are subject to usage limits including a maximum of 3 polls and 50 responses per poll. Paid plan features and limits are described on the Pricing page.
Paid subscriptions are billed in advance on a monthly or annual basis. All payments are processed securely through Stripe. By subscribing, you authorize Pollburst to charge your payment method on a recurring basis until you cancel.
You may cancel your subscription at any time through the billing portal in your account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.
6. Content Ownership
You retain ownership of all polls, questions, and content you create on Pollburst. By using the Service, you grant Pollburst a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service.
Poll responses collected through your polls are owned by you. Pollburst does not sell your poll data to third parties.
7. Disclaimer of Warranties
The Service is provided "as is" without any warranties of any kind, express or implied. Pollburst does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Service is at your own risk.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Pollburst shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of profits, arising out of or related to your use of the Service.
9. Changes to Terms
We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes by updating the date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated terms.
